Site use. Not a contract for outcomes.
- The site informs; it does not provide professional advice.
- Published data carries source dates and boundaries.
- No outcome is guaranteed.
Agreement, eligibility, and authority
Who may use the site and what using it means.
Acceptance
By accessing or using the site, localized pages, public previews, demonstrations, or any portal access not yet governed by another agreement, you accept these Terms and the Privacy Policy. If you do not agree, do not use those surfaces.
Age and capacity
You must be at least 18 and legally able to accept these Terms. If you act for an organization, you represent that you have authority to bind it; “you” includes that organization.
Priority of terms
A signed order, statement of work, services agreement, data-processing agreement, or BAA controls its subject matter if it conflicts with these Terms. These Terms do not amend a signed agreement.
Changes
We may update these Terms prospectively. We will change the effective date and provide any additional notice required by law. Continued use after the effective date accepts the updated version.
Information, public records, and evidence
What the site may show and how it should be read.
Informational surface
The site describes Credalyst, its products, methods, public artifacts, and ways to begin. Visiting, submitting an inquiry, or viewing a demonstration does not create a customer, professional, advisory, fiduciary, employment, agency, partnership, or joint-venture relationship.
Public sources
Facility examples and CMS previews derive from published records and describe the cited record, source, method, and date. Sources may change, be corrected, lag, or contain errors. Credalyst does not control or warrant a third-party source.
No advice
Nothing on the site is legal, clinical, medical, regulatory, accounting, tax, investment, or survey-outcome advice. Do not use the site for emergencies or as a substitute for qualified professionals, primary-source review, or operational judgment.
Products, decisions, and outcomes
The boundaries around Survey Command, Monitoring, Recovery, and Due Diligence.
Organizes evidence and priorities; it does not guarantee survey outcomes or replace facility responsibility.
Monitors changes in agreed sources and criteria; it does not promise instantaneous, complete, or uninterrupted detection.
Analyzes authorized evidence under separate terms; any recovery fee depends on agreed verification, not an estimate.
Supports review and traceability; it is not an investment recommendation, valuation, audit, or performance guarantee.
Credalyst does not guarantee regulatory outcomes, financial recovery, savings, organizational improvement, absolute accuracy, continuous availability, or investment performance. Decisions, approvals, and actions remain the responsibility of authorized people.
Accounts, access, and acceptable use
Limited permission, protected credentials, and prohibited conduct.
License to use
Subject to these Terms, Credalyst grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use the site for lawful internal evaluation or business-engagement purposes. No other right is granted.
Accounts
Keep credentials and access links confidential, use only authorized accounts, provide accurate information, and promptly notify us of unauthorized use. You are responsible for activity performed through credentials under your control. We may limit or suspend access to protect people, customers, data, or the service.
Prohibited use
- Violate law, rights, consent, privacy, or third-party terms.
- Bypass controls, test vulnerabilities without authorization, interfere, overload, or introduce harmful code.
- Impersonate, gain unauthorized access, harvest personal data, or use bots, scraping, or automation that degrades the service or violates rights.
- Copy, resell, publish misleading comparisons, reverse engineer, or build a competing service from protected elements, except where law permits.
Inquiries, customer materials, and regulated data
What you may provide and what requires another boundary.
Your representations
You represent that information you provide is accurate, you have the right and authority to provide it, and our use under these Terms will not violate rights or obligations.
Public inquiries
Do not submit PHI, clinical records, credentials, secrets, full payment data, or sensitive personal information through public forms, unarranged email, command search, or demonstrations. A general inquiry does not create a duty of confidentiality.
Authorized materials
Customer materials, including sensitive Recovery evidence, are accepted only in an authorized workspace and scope. The signed agreement controls purpose, access, security, use, retention, return, deletion, and responsibility.
HIPAA
Do not send PHI until the parties determine their roles and a BAA is in place when required. The public site is not an emergency service, clinical record, or covered entity Notice of Privacy Practices.
AI, external services, payments, and communications
Supporting systems with limited roles.
Automated assistance
Intent assistance helps with navigation; it is not advice and does not make consequential decisions. Deterministic rules run first. Only after an explicit choice may a model classify a limited question into an approved route, but it cannot create a product claim, evidence item, price, recommendation boundary, or customer action. Do not rely on it as the sole basis for a decision.
Third parties
The site may link to or depend on external sources and providers. Their services and terms are their own. Credalyst does not control their sites, content, availability, or practices, and a link is not an endorsement.
Payments and orders
Authorized payments are processed through Stripe or another identified provider. The applicable order or agreement controls price, taxes, billing, renewal, cancellation, credits, and refunds. Unless that document says otherwise, a payment, quote, link, or receipt does not create or expand a service. You authorize charges described in the order and represent that you are authorized to use the payment method.
Email and electronic communications
You agree to receive transactional, legal, security, and service communications electronically at contact details you provide. You may retain copies. Marketing communications, if any, remain subject to applicable consent and opt-out choices.
SMS messaging terms
Credalyst Health's messaging program sends only operational, account-related, or service-related text messages for which a recipient has enrolled. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe or HELP for help. For support, email hello@credalysthealth.com. Wireless carriers are not liable for delayed or undelivered messages. Consent to receive text messages is not a condition of purchase. See the Privacy Policy.
Intellectual property and feedback
What belongs to Credalyst and how to report a concern.
Ownership
Credalyst and its licensors retain all rights in the site, software, design, selection, original text, marks, methods, compilations, and artifacts, excluding customer materials and external-source data. “Credalyst” and related marks may not be used without written permission.
Feedback
If you voluntarily provide non-confidential ideas or feedback about the service, you grant Credalyst a worldwide, perpetual, irrevocable, royalty-free, sublicensable license to use and develop it without attribution or compensation. Do not include confidential or personal information.
Copyright concerns
To report material you believe infringes copyright, email hello@credalysthealth.com with your physical or electronic signature, the work, the exact location, your contact information, a good-faith statement, and a statement under penalty of perjury about accuracy and authority. We do not claim a statutory safe harbor we have not established.
Availability, warranties, and liability
Risk allocation for the public surface.
To the fullest extent permitted, the site, public content, demonstrations, and previews are provided “as is” and “as available.” Credalyst disclaims implied warranties of merchantability, fitness, title, non-infringement, accuracy, and availability. We do not promise the site will be uninterrupted, secure, or error-free.
To the fullest extent permitted, Credalyst and its affiliates, officers, employees, and providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or lost profits, revenue, data, goodwill, or opportunity arising from the public site.
To the fullest extent permitted, total liability related to the public site will not exceed the greater of US $100 or the amount you paid specifically for public-site access during the prior twelve months. A signed agreement sets the applicable cap for paid services.
Some laws do not permit certain exclusions. Nothing excludes liability that cannot lawfully be limited or alters non-waivable rights. Exclusions apply only to the extent permitted by law.
You will indemnify and defend Credalyst against third-party claims, losses, and reasonable costs arising from your materials, unlawful or unauthorized use, or breach of these Terms. Credalyst will notify you of the claim and permit a reasonable defense; you may not settle by imposing obligations on Credalyst without consent.
Suspension, disputes, and general terms
How access ends and how the contract is interpreted.
Suspension and termination
You may stop using the site at any time. We may suspend or terminate access for breach, risk, legal requirement, discontinuation, or protection of the service. Provisions that by nature should survive—including ownership, disclaimers, liability, indemnity, and disputes—survive.
Law and courts
These Terms are governed by New Jersey law, without its conflict-of-laws rules. The parties submit to the exclusive jurisdiction of state and federal courts with jurisdiction over Passaic County, New Jersey, unless applicable law requires another forum. Before filing a claim, the parties will try in good faith to resolve it for 30 days after written notice.
Legal compliance
You must comply with applicable laws, including export restrictions and sanctions. You may not use the service where legally prohibited. Credalyst may comply with valid legal process and protect rights, safety, and integrity.
Contract mechanics
These Terms and the Privacy Policy are the entire agreement for the public surface. If a provision cannot be enforced, it will be limited to the minimum necessary and the remainder continues. Failure to enforce is not a waiver. You may not assign these Terms without consent; Credalyst may assign them in a reorganization, financing, merger, acquisition, or asset sale. There are no third-party beneficiaries.
Notices and questions
Notices to Credalyst must be sent to hello@credalysthealth.com and identify the subject and organization. We may send notices to the address associated with your inquiry or account or post them where law permits. Credalyst Health LLC is located in Passaic, New Jersey, United States.
